Lang <br />Division Director <br />RE: Milliken Resource 112 Amendment Adequacy Review, Aggregate Industries-WCR, [nc. <br />Permit No. M-2000-087 AM-001 <br />r--^ <br />Dear Mr. Roche: <br />The Division has completed it's adequacy review for your Milliken Resource Amendment 1 application. The <br />date for the Division's staff recommendation to the Mined Land Reclamation Board is November 26, 2001. <br />Therefore the Division would appreciate a response from you or before November 21, 2001. Please advised that <br />your application may be deemed inadequate and a recommendation for denial made to the Mined Land <br />Reclamation Board on November 26, 2001 unless the following adequacy review items are addressed to the <br />satisfaction of the Division. If additional time is needed to prepare and submit an adequacy response, the <br />applicant may waive their right to a decision within 90 days and request an extension of time: However, such <br />request must be made in writing and will need to be received by [he Division on or before November 26, 2001. <br />6.4.3 EXHHiIT C-Pre-mining and Mining Plan Map(s) of Affected Lands <br />Rule 6.2.1(2) Requires that "Maps, except the index map, (b) must be prepared and signed." Rule <br />6.2.1(d) requires that maps must identify and outline [he area which corresponds with [he application. <br />Please provide the Division with a full set of maps with the preparers signature and with the permit <br />boundazies identified. <br />2. The mining plan map provided indicates mining will occur within 200 feet of a number of permanent <br />man-made structures. For clarification, the Division considers [he applicant's commitment in Exhibit S <br />of the application to supercede the information portrayed on the mining plan map. In Exhibit S, the <br />applicant provides a commitment to stay at least 200 feet away from all permanent man-made stmctures <br />until such time that a) the applicant provides agreements between the applicant and the person(s) having <br />an interest in the structure or the applicant will provide an appropriate engineering evaluation that <br />demonstrates [hat such strucmre shall not be damaged by activities occurring at the mining operation. <br />Please acknowledge whether this understanding is correct. <br />Please note that Rule 6.4.19(a)-Exhibit S requires that agreements between the applicant and the <br />person(s) having an interest in the structure must be notarized. <br />6.4.7 EXHIBIT G-Water Information <br />The applicant has stated that "Since temporary substitute water supply plans must be renewed every <br />two years, the expanded mining area a11d ponds will be incorporated as mining progresses into the new <br />area" <br />
