Please commit to providing written verification from the Office of the State Engineer of approval of all <br />necessary permitting requirements prior [o dewatering, exposure of groundwater, or use of groundwater <br />at the site. <br />2. The Division has not found any assessment of potential impacts to the groundwater system in the <br />application. The Division has received an objection from an adjacent landowner, Mr. Gene <br />Kammerzell, concerning potential impacts to his domestic wells and his irrigation well. Please provide a <br />ground water report which addresses the potential for impacts to Mr. Kammerzell's wells and any other <br />adjacent wells, and any proposals which the applicant will make to mitigate any potential impacts. <br />Please also discuss what conditions will trigger any mitigation. <br />6.4.8 EXHII3IT H-Wildlife Infotvttation <br />The Division has received a November 13, 2001 letter from the Colorado Division of Wildlife, <br />requesting that bald eagle monitoring be done for two winter seasons. Will this be done? <br />Also, please provide any documentation which you have conceming mitigation measures which will be <br />taken to protect the Preble's Meadow Jumping Mouse habitat. Has the-applicant contacted the U.S. <br />Fish and Wildlife Service for coordination of this species and the Ute Ladies tresses Orchid? <br />6.4.12 EXHHiIT L-Reclamation Costs <br />The applicant states that "We do not anticipate that the cost to reclaim the expansion area will exceed <br />the original bond calculations." Please commit to notifying the Division if the disturbance on the <br />original and expansion azeas exceed the 65 acre disturbance used to calculate the "worst case" original <br />bond. <br />Please respond to this review on or before November 21, 2001, to allow adequate tome for review <br />before the November 26, 2001, recommendation to the Mined Land Reclamation Board date. <br />Also, please be aware that Rule 1.8.1 states that changes and additions to the pemtit application must be <br />tiled with the Division and the County Clerk and Recorder.
