Long, Director <br />Division of Minerals and Geology <br />Department of Natural Resources <br />1313 Sherman St., Room 215 <br />Denver, CO 80203 <br />RE: Colorado Department of Natural Resources, Division of Minerals and Geology <br />(DMG), Proposed Decision to Approve Phase II and Phase III Bond Release, Eckman Park <br />Mine, Mine No. 2, Permit No. C-81-071, Colorado Yampa Coal Company (CYCC); Bond <br />Release Application No. 6 <br />Dear Mr. Long: <br />This letter acknowledges the Office of Surface Mining's (OSM) receipt and review of DMG's <br />March 30, 1998, proposed decision for Phase II and Phase III bond release on Mine No. 2, at <br />CYCC's Eckman Pazk Mine, Permit No. C-81-071, which includes Federal lands. OSM is in <br />agreement with the proposed decision and hereby provides OSM concurrence to the Phase II and <br />III bond release in accordance with Article VIII of the State-Federal Cooperative Agreement, <br />codified at 30 CFR 906.30.24. <br />DMG conducted the Phase II and III bond release inspection required at Colorado Rule 3.03.2 (2) <br />on October 14, 1997. DMG conducted afollow-up inspection on November 18, 1998 to confirm <br />that items identified in the October inspection had been resolved. DMG's proposed decision <br />documents the inspection findings and indicates that all required public notices and surface <br />landowner notifications were made in a timely manner prior to the inspection. The ownership of <br />the land surface for which bond release has been requested is private, and the coal ownership was <br />private and Federal. <br />The OSM Denver Field Division (DFD) participated in the bond release inspections noted above <br />and inspection findings are documented in the OSM Mine-Site Evaluation Inspection Report <br />dated October 14, 1997. The United States Department of the Interior, Bureau of Land <br />Management (BLM) was notified of the inspections and indicated they would not participate. <br />
