Sun Coal is <br />providing the attached replacement pages for the permit document, which constitute the <br />substance of the technical revision. Sun Coal will address each of the points contained in the <br />Division's May 31, 1994 correspondence. <br />a. The structures currently on site are already addressed in Section 2.05.3 and illustrated on <br />Map-7, Mine Facility Map. <br />b. The only structure remaining at the facilities area which is proposed for removal is the <br />Yampa River Sedimentation Pond. <br />c. The list of structures which were approved for retention by the landowner are identified on <br />page 338-A of the permit document. The Division has required a specific list of structures <br />to remain, a brief description of its intended use, and how that use will coincide with the <br />approved post mining land use. The listed regulatory citations (2.05.5(1)(a)(iii) and <br />2.05.5(1)(b)) do not provide a basis for this request by the Division. These citations refer <br />to the discussion, in the initial permit application, of whether the proposed post-mining <br />land uses are appropriate. With approval of the permit the Division has already approved <br />the post-mining land use of light industrial for areas under the surface ownership of Mr. <br />John Eilts. <br />
