Ms. Susan Burgmaier <br />June 30, 1994 <br />Page 2 <br />The gravel road base in the facilities area will remain to ensure the surface stability of the <br />roads, scale area, and office trailer area. Sun Coal is unaware of any remaining coal fines <br />in the facilities area. Some in-place coal from the outcrop has weathered away from the <br />slope, but this is not related to Sun Coal reclamation. Sun Coal is unaware of any specific <br />debris which is the property of Sun Coal which has not been removed and disposed of. <br />Materials in the shop area, loadout area, and north of the Yampa River are the property of <br />the landowner, Mr. John Eilts. <br />e. Since the facilities area has an approved post-mining land use of light industrial, there is no <br />requirement for replacement of topsoil. <br />f. There is no plan for revegetation of the facilities area, as revegetation would be <br />inconsistent with the approved post-mining land use of light industrial. <br />g. At this time, there are two existing ground water wells at the mine site, the coal <br />crusher well and the office trailer well, as described on page 338 of the permit <br />document. These wells are proposed for transfer to the landowner who has <br />expressed an interest in using and maintaining the wells. Transfer of wells, at a <br />time to be determined by Sun Coal, and prior to final reclamation bond release, will <br />be in accordance with the provisions of Section 4.05.14 of CDMG regulations. <br />This commitment has been added to page 338 of the permit. <br />h. At this time, the only facilities area structure proposed for removal is the Yampa River <br />Sedimentation Pond. This structure may not be removed until such time as Sun Coal <br />demonstrates, to the Division's satisfaction, that the pond is not necessary for <br />sedimentation control. Any commitment to remove the pond prior to that demonstration <br />would be unfeasible and not in compliance with Division and CDOH requirements. <br />Michael Savage and I are available to discuss any aspect of the facilities area reclamation or <br />the proposed technical revision.
