Long <br /> <br />Re: Preliminary Adequacy Review, PR-03, New Horizon Mine 2, Permit No. C-81-008 Division Director <br />Dear Mr. Gubka <br />The Division has completed portions of the preliminary adequacy review of your retent permit Revision. The <br />sections that have been reviewed include 2.03 Legal, Financial, Compliance, and Related Material; 2.04.(5-6-7 ) <br />Ground Witter Hydrology/Geology; 2.04.9 Soils; 2.04.12 Prime Farmland; 2.05.3 Topsoil Removal & 2.05.4 <br />Topsoil Redistribution; 2.04.10 Vegetation; and 2.05.4 Revegetation Plan. Review comments on Surface Water, <br />Roads, Blasting and other topics will be forthcoming in about 2-3 weeks. Review of the worst case bonding <br />scenario will commence with the submittal of the estimate. <br />The following issues will require additional information, correction or action. If any of the issues will require an <br />extended period of time before a response can be submitted, please hold those items in abeyance and submit the <br />other actions in a timely manner. <br />LEGAL AND FLNANCIAL SECTION: (Note, the tx~o items irr this secriorr were complied tvirh on Oct 20, 99) <br />I. For Western Fuels-Colorado there is in the AVS one Jim C. Soehner, who is listed as a Director, but with no <br />Begin date. In the submittal of information, 1im C. Soehner is also not listed. Please provide documentation <br />with an end date so that AVS may be updated. <br />2. For Tri-State Generation there is in the AVS, Directors (See lilt below) which are not in the new submittal of <br />information. Please provide a Geologic Structure contour map with a maximum contour interval of 10 feet drawn on top of <br />the lowest coal seam that will be mined. <br />2. Projected location of spoil spring. A spoil spring can be expected to eventually develop on [he ground <br />surface near a pit spill-point (the lowest point along the lowwall crest of the pit excavation). Please identify <br />the location and elevation of what will be the single lowest point along the entire crest (top of the edge) of the <br />mining excavation at the New Horizon #2 Mine prior to backfilling. <br />
