Cattany Somerset, Colorado 81434 Division Director RE: Terror Creek Loadout, Permit No. C -83-059, Terror Creek Co., Permit Renewal No. 4 Dear Mr. Kiger: The Division of Minerals and Geology (Division) has finished its review of the two submittals dated April 23, 2003 and May 8, 2003 from Oxbow Mining LLC (Oxbow) for the Terror Creek Loadout Permit Renewal No. 4. The submittals were in response to the Division's adequacy review letter dated March 25, 2003. The operator is the Terror Creek Company (TCC). The Division has the following questions and comments: Section 2.03.3, Format and Suoulemental Information Please revise the name of the environmental coordinator on page 2.03-2R of Volume I of the permit application. The Division has no further concerns. Page 2.03-2R was revised in the submittal dated May 8, 2003. Section 2.03.4 Identification of Interests 2. Please update the identification of interests information that is required in Sections 2.03.4(1) through (10) of the permit application, where applicable. The updates should include, but not be limited to, ownership and control information that is required in Section 2.03.4(3) and (4), the list of the owners of record of surface areas to be affected and the list of owners of record of the coal to be mined, as required in Section 2.03.4(6) and the list of the owners of record of the surface and subsurface areas that are contiguous to the permit area that is required in Section 2.03.4(7). TCC provided revised pages 2.03-SR, 2.03-6R, 2.03-6Ra, 2.03-7R and 2.03-8R in the submittal dated May 8, 2003. However, there is an issue with one item on revised page 2.03-6Ra. This issue is dealt with in item number 9 below since it involves the Applicant Violator System (AVS). Because there were recent changes in surface ownership, TCC also revised Map 1, Surface Ownership, along with an updated list of surface owners on revised page 2.03-9R, both provided in the submittal dated May 8, 2003.
