Box 1094 , <br />Craig, CO 81626 ~~~~ u~ Mmece~s and G•d~ <br />(970) 824-2850 <br />RE: Request to Leave Permanent Structures on State of Colorado Lands <br />Mr. Osborn, <br />Seneca Coal Company (SCC) holds a surface lease on portions of Colorado State Land Board controlled lands in Routt <br />County, Colorado. SCC operates and conducts reclamation at the Seneca II Mine, which includes State of Colorado <br />controlled lands, under a Colorado Division of Minerals and Geology (CDMG) Mine and Reclamation Permit (Pertnlt <br />No. C-80-005). As part of the future final reclamation p]an, Seneca Coal Company proposes to leave a variety of <br />structures/facilities within the State of Colorado lands as permanent features. <br />The Colorado Mined Land Reclamation Board Regulations for Coal Mituug, Rule 2.05.5(1)(6) states...'Ihe postmining <br />land use description shall be accompanied by a copy of the comments concerning the proposed use by the legal or equitable owner of record of <br />the surface of the proposed permit area and the State and local government agencies which would have to initiate, implement, approve, or <br />authorize the proposed rue of the land following reclamation': The features proposed as permanent include: <br />• Livestock Watering Tanks (11 tankr) -retention of these stock ponds was approved on October 28, 2002 in a letter <br />from Mazk Davis, Minerals Director, Colorado State Land Board, to Sandy Brown, Colorado Division of Minerals <br />and Geology. (l etler attached) <br />• Roads (48,200 feet/9.1 miksf -see attached map <br />• Sedimentation Ponds/Itnpoundments (3 paretic) -see attached map <br />The State of Colorado lands, within the Seneca II Mine pemut boundary, include all or portions of the following: <br />Township 6 North. Range 87 West <br />Section 36 (portion of) <br />Townshio 5 North. Ranee 87 West <br />Section 1 (portion of) <br />Section 2 (all) <br />Section 3 (portion oE) <br />Section 11 (portion of) <br />Section 12 (all) <br />Section 13 (portion of) <br />Seneca Coal Company • P.O.
