Cattany <br />Acting Division Director <br />Re: Montgomery Pit, Permit No. M-1986-104, Pie/iminary Adequacy Review for AM-01. <br />Dear Mr. Lewicki: <br />Staff has begun the review process for the above referenced amendment (AM-01). The <br />amendment will change the post mine land use and remove acreage that will not be <br />disturbed in the final phase of mining. These changes will also abate issues noted in <br />8/1 /02 inspection. Please address and respond with corrections or additional information <br />to the following issues: <br />1) The Division has received comments from the Office of State Engineer (OSE) <br />concerning statements and questions of water rights. (enclosed) Please supply <br />documentation to this Office that verifies the operator has addressed the issues <br />raised by the OSE to that office. <br />2) Staff requests that a faxed copy of the public notice being printed in the local <br />newspaper is forwarded as soon as possible for review. This will he-p staff <br />establish the end of public comment period and ensure the notice meets the <br />requirements. The affidavit and hard copy may be sent later. <br />3) In the Mining Plan, Exhibit D, the placement of "isolation berms are noted along <br />the northern border. Staff asks for a clarification as to the type of material for <br />construction of this berm. Will it also be topsoil or some other material? <br />4) Part of the narration on the pit operation sounds as if the entire site will remain <br />permitted until the Staging Area is done as a processing site. The operator may <br />not be aware that once the slopes are reclaimed, with an approved Conditional <br />Use Permit from Eagle County, the entire "commercial !industrial area (the pit <br />floor) maybe able to be released. This could be done when material begins to be <br />brought in from other sites for processing into concrete or asphalt at the <br />conclusion of excavation on site. The slopes would be the only areas that would <br />have to remain under the permit until vegetation is satisfactory for release. <br />
