~ Ill IIIIIIIIIIIIIIII ,~
STATE OF COLORADO
Roy Romer, Gove
DEPARTMENT OF NATURAL RESOURCES
MINED LAND RECLAMATION DIVISION
FRED R. BANTA, Director
January 9, 1989
Mr. Herman Altergott
Best-l9a.y Paving Company
P.O. Box 3189
Greeley, Colorado 80633
RE: Request for Transfer of Mineral Permit
Starling Paving Company
Caliche School Pit
MLRD Permit No, f4-88-106
Logan County, Colorado
Dear Mr. Altergott:
Upon review of your Colorado Department of Highways Contract for Project
No. CX(GF) 13-0138-07, it is apparent that this project began in the fall of
1988, prior to your request for this permit transfer. In addition, from a
telephone conversation with the Department of Highways today, it is also
apparent: that this job has been temporarily halted and will not be reactivated
until ttris spring.
4Je are sorry to inform you we cannot transfer this permit to you as a
111 Special Operations Permit. State law requires that the submitted State
Department of Highways contract call "for work to be commenced within a
specifically short time". This normally means less than 30 days, the time
required to approve a 110(2) Limited Operations Permit. Therefore, this pit
can only be transferred to you as a 110(2) operation.
I have discussed your situation with Loring Knutson at Sterling Paving today
and he stated that they would be willing to convert their existing 111 permit
to a 110(2) prior to transferring the pit to you. To accomplish the transfer,
the following needs to be done:
1. Sterling Paving needs to request a Conversion of their existing
111 Special Operations Permit to a 110(2) Limited Impact
Operations. This request should include the basic 110(2)
application fee of X25.00• This can be done as a simple letter as
there is no special form necessary.
2. Upon receipt of this request and fee, the Division will notify
Sterling Paving that their Permit Conversion request is complete.
lJe will, at that time, ask Sterling Paving to publish once in the
Sterling newspaper a Public Notice of the proposed conversion and
to notify all surface landowners of the affected and immediately
adjacent lands.
215 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
