Mr. Herman Altergott - 2 - January 6, 1989 <br />3, Once the Division has received the proofs of publication and <br />notification of landowners and the required time period for public <br />comment has passed, we will approve the conversion. We will, <br />however, maintain Sterling Paving's E12,500.00 Financial Warranty. <br />4. After Sterling Pa ving's Conversion is approved, then Best-Way <br />Paving will need to submit a fully executed "Request for Transfer <br />of Approved Mineral Application and Succession of Permit Applicant" <br />(enclosed). In addition, a new replacement financial warranty in <br />the amount of E5000.OG should be submitted also at this time. <br />Again, these items should not be submitted until Sterling Paving <br />Company's Conversion is approved. <br />Once the fully executed transfer request and replacement financial <br />warranty from Best-Way Paving are approved, the Division will then <br />return to Sterling Paving its E12,500.00 financial warranty. <br />Sterling Paving at that time would be released from reclamation <br />responsibility and Best-Way Paving would be the permitted operator <br />fora new 110(2) Limited Impact Operations Permit, <br />I realize this may be more than a bit confusing. However, this will ailow <br />Best-Iday Paving to not only receive a permit for the Calicne School Pit, but <br />also one that will require a smaller bond and a lower annual fee. Please find _' <br />enclosed Corporate Surety Bond No. 556443 in the amount of E12,500.00 and the <br />Perfo~Tnance Warranty you originally provided for this operation. ~J <br />Pleases do not hesitate to call if you have any questions. <br />Si ncer•ely, <br /> <br />Daniel I.
