Set forth below are responses to the specific requests for additional information <br />that were contained in your letter. <br />Please verify the current land and mineral ownership in the permit <br />application is correct, or provide updated information (Sections 2.03.4(6) <br />and (7)). <br />Except as updated in response to question 2 below, MCC has reviewed <br />and hereby confirms that the land and mineral ownership information in <br />the permit record is current and correct. <br />2. There are typographical errors ... . <br />Thanks. A faxed copy of corrected pages are attached hereto. A clean <br />copy of these pages will arrive soon under separate cover. <br />3. It is not apparent whether MCC has arranged to transfer all rights of <br />entry to MCC, LLC. Please provide information which indicates the <br />status of all rights of entry currently held by MCC (Section 2.03.6). If the <br />transfer will be directly to Arch Coal, lnc., the same information will be <br />required for Arch. <br />All federal and private coal leases are assignable and are now held by - <br />or have recently been assigned from ARCO to -MCC (as reflected in <br />the attached assignment documents). Further transfer of these rights of <br />entry will be accomplished by merger of MCC into MCC, LLC. <br />Otherwise, the status of all rights of entry currently held by MCC has not <br />changed from the status currently of record.
