Long
Drvrsion Direuor
This letter is in response to our phone conversation on Tuesday, December 21, 1993. The
Division appreciates the cooperative response we have received from the City of Trinidad in
resolving the complex issues surrounding bond release for the Burlington Northern Railroad
Loadout.
This letter will provide a summary of the progress, for your records.
On November 11, 1993, a bond release inspection occurred at the Burlington Northern Railroad
Loadout. Representatives from the City of Trinidad, Energy Fuels Mining Company (EFMC) and
the Division were present. A copy of the Division's report from that inspection has been
provided.
On November 30, 1993, the Office of Surface Mining (U.S. Department of the Interior)
conducted their follow-up inspection of the site. Please find enclosed a copy of the OSM
inspection report. The OSM report restates many of the issues discussed during our
November 11, 1993 inspection.
The OSM has determined that Phase I bond release cannot be granted until the topsoil stockpile
located on the south end of the permit area has been regraded or removed. The Division has
contacted the Colorado Department of Transportation (CDOT- and EFMC with inquiries for
removing the topsoil stockpile.
CDOT has responded that funds for immediate removal of the stockpile do not exist. CDOT is
planning to utilize the topsoil in the final construction phase of the Trinidad Bypass project and
speculates that they will not remove the stockpile until 1995. EFMC has also responded that
funds for immediate removal of the stockpile do not exist.

STATE OF COLORADO
