<br /> <br />Mr. James Fernandez -2- December 22, 1993 <br />Utility Superintendent <br />City of Trinidad <br />On December 21, 1993, the Division discussed with the City of Trinidad a proposal by which <br />the City would consider removal of the stockpile. The Division's discussion with the City of <br />Trinidad regarding removal of the topsoil stockpile reflects our desire to assist the City and <br />EFMC in resolving this situation by bringing to light all possible solutions. Until final approval of <br />Phase 1, II and III Bond Release, State law requires EFMC to be responsible for reclamation of <br />the Burlington Northern Railroad Loadout. If the topsoil stockpile remains on site until 1995, <br />EFMC will need to obtain right of entry from the City of Trinidad to the site, to maintain their <br />sediment control structures, mine identification signs and perimeter markers. <br />The Division will continue to pursue every conceivable option afforded by the Colorado Surface <br />Coal Mining Reclamation Act and the Regulations of the' Colorado Mined Land Reclamation <br />Board.
