Long <br />Drvrsion Direuor <br />This letter is in response to our phone conversation on Tuesday, December 21, 1993. The <br />Division appreciates the cooperative response we have received from the City of Trinidad in <br />resolving the complex issues surrounding bond release for the Burlington Northern Railroad <br />Loadout. <br />This letter will provide a summary of the progress, for your records. <br />On November 11, 1993, a bond release inspection occurred at the Burlington Northern Railroad <br />Loadout. Representatives from the City of Trinidad, Energy Fuels Mining Company (EFMC) and <br />the Division were present. A copy of the Division's report from that inspection has been <br />provided. <br />On November 30, 1993, the Office of Surface Mining (U.S. Department of the Interior) <br />conducted their follow-up inspection of the site. Please find enclosed a copy of the OSM <br />inspection report. The OSM report restates many of the issues discussed during our <br />November 11, 1993 inspection. <br />The OSM has determined that Phase I bond release cannot be granted until the topsoil stockpile <br />located on the south end of the permit area has been regraded or removed. The Division has <br />contacted the Colorado Department of Transportation (CDOT- and EFMC with inquiries for <br />removing the topsoil stockpile. <br />CDOT has responded that funds for immediate removal of the stockpile do not exist. CDOT is <br />planning to utilize the topsoil in the final construction phase of the Trinidad Bypass project and <br />speculates that they will not remove the stockpile until 1995. EFMC has also responded that <br />funds for immediate removal of the stockpile do not exist. <br /> <br />STATE OF COLORADO <br />
