The Division received your letter dated September 13, 1999 requesting a 90- <br />day extension of the Division's decision due date. The Division of Minerals and Geology (Division) is <br />required to make an approval or denial decision no later than January 10, 2000, therefore, your response <br />to the following adequacy review concerns should be submitted to the Division as soon as possible. <br />As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice circulated <br />in the local newspaper and all owners of record of surface lands, and easement holders that are <br />within 200 feet of the boundary of the affected land. Proof of notice may be return receipts of a <br />Certified Mailing or by proof of personal service. <br />Rule 6.4.3 Exhibit C- Pre-Mining and Minin¢ Plan Mag(s) of Affected Lands <br />2. Exhibit C-1 depicts structures located within the permit area. However, the area outside of the <br />permit area (south of the permit area along Hygiene Road, southwest of the foothills inlet and west <br />of Foothills Highway) is not depicted on the Exhibit. The Division needs to determine what is <br />surrotmding the permit area, specifically, permanent man-made structures within 200 feet of the <br />affected area. Please revise the map accordingly. <br />Rule 6.4.3(g) requires the applicant to show the owner's name of structures within 200 feet of the <br />affected land. Please indicate the owners of all structures located inside the affected area and within <br />200 feet of the affected area. Such structures as defined by Rule 1.1(48) include buildings, houses, <br />barns, fences, above or below ground utilities, irrigation ditches, maintained or public roads, bridges, <br />railroad tracks, cemeteries, communication antennas, pipelines, water wells, water storage <br />impoundments, dischazge and conveyance structures, etc... If any structures will be removed or <br />relocated, please state that fact in the application and, if appropriate, include the relocated structure <br />on the Exhibit. <br />
