The Division of Reclamafion, Mining and Safety ("Division") is <br />required to make an approval or denial decision no later than August 13, 2007, therefore, your response to the <br />following adequacy review concerns should be submitted to the Division as soon as possible. <br />1. The Applicant did not provide proof of public notice to the owner of Highway 287 and the Poudre Valley <br />Canal. Both of these easements and structures are within 200 feet of the affected land. Please also state the <br />adjacent owners north, south and east of the site. As required by Rule 1.6.5 (2), please submit the proof of the <br />public notice circulated to the owners of Highway 287, the Poudre Valley Canal and other surface owners that <br />may exist north, south and east of the site (and also note them on the map). Proof of notice may be return <br />receipts of a Certified Mailing or by proof of personal service. <br />If the Applicant failed to notify an adjacent surface or easement holder, the applicant will need to notify the <br />said party and allow for an additional 20-day comment period. The Division's decision date will need to be <br />extended by the Applicant to account for the public comment period. <br />2. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional engineer, or other <br />qualified person. The revised maps submitted by the applicant need to be signed. Please resubmit a signed <br />copy of the maps. <br />Rule 6.4.4 Exhibit D-Mine Plan <br />3. Please state the total affect area within the 58.75 permit area. For example, specify the acres to be mined, the <br />acreage associated with roads and the acreage associated with existing and future stockpiles. Based on the <br />Master Map, it appeazs that all but 20 acres will be disturbed by mining (a total of 38.75 acres). Please <br />confirm this disturbed acreage. <br />Rule 6.4.5 Exhibit F- Reclamation Plan <br />4. Based on the response from the applicant, all overburden piles will be placed back into the pit.
