Brown & Associates on March 8, 2004. The county <br />appreciates being kept abreast of Everist Materials plans and proposed activities. <br />Afrer reviewing the materials submitted to the Division of Mineral and Geology I have the following <br />observations and comments. <br />• The county has no objection to the planned expansion of the Everest Materials Mascot Placer to <br />include 79.1 acres, conversion of the 110 permit #M1998-052 to a 112 permit, or proposed post- <br />mining land use for wildlife habitat. <br />• The county understands all lands in the existing permit will be incorporated into the new permit; the <br />only change in the operation is an increase in acreage and mining operations will supposedly stay the <br />same. <br />• As you are aware the county recently adopted new mining regulations, which could affect your <br />proposed on-site processing of crushing screening. As stated in the Construction Materials Regular <br />(112) Operation Reclamation Permit Application Form the proposed mining method was a "front-end <br />loader to screening/crushing, to stockpile to truck, to market." <br />The county mining regulations were written to exempt removal of dredge spoils from conditional use <br />permit review (in-part because of your input). However, the county mining regulations exempt <br />screening of dredge spoils, not crushing. The specific language adopted in Chapter 3 of the Summit <br />County Land Use And Development Code reads as follows: <br />"3812.11 Exemptions <br />The following types of excavations and operations are not considered mining or milling operations <br />and are exempt from these mining regulations though not exempt from other regulations in this Code: <br />
