I am trying not to amend our permit at this time. For one
thing, Jim isn't able to help me with the information. Another is we have
recieved 3 packages from Carl Mount and there isn't any thing pertaining to
an amendment of a permit. It has a place to check for new permit, we
already have a permit (M1992-045) and another place to check for a
conversion. I am at a loss on what and how to do the paper work.
This is what I found in your rule book: The Rule 1, 1.1 definition of
regulations under number 4 "Effected Lands" (All lands shall be excluded
that would be otherwise included that reads effected lands shall not include
off site roads which exist prior to the date on which notice was given or
permit application) Our permit area is 2.8 acres and we set the markers at
3.8 acres allowing 1 acre for access roads into and to cross the effected area
or boundry area to be able to service the rest of our 160 acres. When you
check it with a GPS, such as yon did it puts us 1 acre over 2.8 acre permit
which makes us inviolation of our contract. Since we cannot mine an
existing road, we feel we may not Have to amend our permit.
Enclosed is a map where the roads are on the effected area property that are
being used for maintauce and other things that a property owner mast do for
the reason of real estate ownership.
I would like to give you a list of roads on the enclosed map so that you are
aware that there is more than 1 of an acre as you stated to Mr. Humphries.
There is a total of 5 roads you may not be aware of. You had to be on a road
to get to the effected area, which a portion of this road is included in our
effected, there is a higher mad above the waste barrell that you walked to
