• <br />Minutes, June 24-25, 1992 <br />999 <br />D FiA~T <br />Subject To Board Approval <br />b) Minerals, Energy and Geology Policy Advisory Board -- the deadline <br />for submittal of applications is 5:00 p.m.,, June 25, 1992. <br />c> HB 1200 -- Study Bill concerning moving the Water Qu~ility Control <br />Division to DNR or to another location. <br />d) Federal Administrative Cost-sharing and the MMS Study (recently <br />completed) -- Subcommittee is asking that the States fund 1007. of <br />all the administrative costs of the MMS, the BLM and the Forest <br />Service that do mineral leasing; approximately $79 million would <br />be deducted from the States' mineral receipts. Colorado has <br />contacted various groups and stated opposition to administrative <br />cost-sharing; the IOGCC in Wichita and the WGA have passed <br />resolutions in opposition to administrative cost-sharing. <br />Staff Presentation by Larry Oehler: <br />FORMAL PUBLIC HEARING <br />BATTLE MOUNTAIN RESOURCES, INCORPORATED File No. M-88-112 <br />333 Clay Street, 42nd floor <br />Houston, TX 77002 <br />All persons wishing to give testimony were sworn. <br />Secs. 15, 16, 17, 20, 21 and 22, T325, R71W, 6th P.M., Costilia County, <br />2,200 acres; 112 open pit gold and silver. Status report on progress <br />towards completion of 12 Board ordered corrective actions, status of <br />reducing the cyanide concentrations of waste stream and waste disposal <br />areas to Levels that comply with the permit and consideration of the <br />Division's recommendation, regarding any further civil penalty. <br />Board Member Stewart announced that in 1984 she purchases stock from a <br />company that was connected with Battle Mountain Resources at that <br />time. However, she said she no longer holds the stock and asked the <br />parties if they would consider this a conflict of interesl-s. There was <br />no objection from the parties to Ms. Stewart hearing this natter. <br />Staff stated that in accordance with Paragraph 18 of tf~e Board Order <br />issued in relation to this matter, the Division would provide an update <br />on compliance with abatement requirements, followed by comments from <br />the other parties. <br />Mr. Frank Johnson, Assistant Attorney General, clarified that although <br />the San Luis (Costilia County) Conservancy District was video taping <br />the hearing, the official record of the proceeding was Being compiled <br />and tape recorded by the Board Secretary. <br />Staff presented EXHIBIT A, an amended abatement requirement summary and <br />discussed the status of each corrective action: 1) tailings area <br />security has been increased, 2) the operator submitted a report <br />assessing the environmental impact of the violation, :l) accelerated <br />frequency of tailings area environmental monitoring is in place and <br />being implemented, 4) cyanide detoxification of the tailings has not <br />
