Caltany <br />Division Director <br />Natural Resource Trustee <br />Listed below aze adequacy review comments for the Platte Valley Operation 112 (c) Amendment Application (AM- <br />001), File No. M-1989-120. The Division of Minerals and Geology ("Division") is required to make an approval or <br />denial decision no later than November 3, 2003, therefore, your response to the following adequacy review concerns <br />should be submitted to the Division as soon as possible. <br />Rule 1.6.5 (2), requires proof of publication of the public notice circulated in the local newspaper and all owners of <br />record of surface lands, and easement holders that aze on the affected land and within 200 feet of the boundary of <br />the affected land. The proofs of notice submitted with the amendment application do not indicate that the utilities <br />within 200 feet of the boundary have been notified. Please supply proof of notice to these entities. <br />Rule 6.4.3 Exhibit C- Pre Mining and Mine Plan Map(sl of Affected Land <br />2. Section (a) of the Pre-Mining and Mine Plan Map(s) of Affected Land requires the Applicant to supply the.name <br />and location of all creeks, roads, buildings, oil and gas wells and lines, and power and communication lines on the <br />area of affected land and within two hundred (200) feet of all boundaries of such azea. The owners of the oil and <br />gas facility and the utilities do not appear to be listed on the map. Please supply this information. <br />3. Section (g) of Exhibit C requires the Applicant to show the owner's name, type of structure, sand location of all <br />significant, valuable and permanent man-made structures contained on the azea of affected land and within two <br />hundred (200) feet of the affected land. None of the structures on the map indicate ownership of these structures. <br />Additionally it is unclear as to which adjacent landowner some of the neazby buildings belong. Please specify the <br />owners of man-made structures contained in and within 200 feet of the permit boundary. <br />4. The Pre-Mining/Mine Plan Map indicates the "approximate anticipated location of aggregate mineral conveyor <br />bridge." Please be awaze that this bridge location is not included within the current permit boundary and this area <br />would have to be amended to this or an adjacent permit prior to installation of the bridge. <br />5. According to the cross section included on the Pre-Mining/Mine Plan Map, the proposed setback from the permit <br />boundary will be 50 feet. The plan view of the map, however, indicates that setbacks will be 25 feet. Please <br />clarify this discrepancy. <br />6. Although the Pre-Mining/Mine Plan Map depicts the locations for overburden stockpiles, topsoil stockpiles are not <br />depicted on the map.
