Rule 6.4.4 Exhibit D- Mining Plan <br />The Mining Plan submitted with the application indicates that 18 acres contained within the existing permit is to be <br />removed from the permit and 67 acres will be added. Please be aware that the removal of 18 acres from the permit <br />is considered an Acreage Reduction (AR) and cannot be incorporated in the amendment process. In order to have <br />these 18 acres removed from the permit, an acreage release request must be submitted to the Division for review. <br />The inspection for the AR request can be conducted at the same time as the pre-operational inspection for the <br />amendment if the Division receives the acreage reduction request within 60 days of when the inspection is <br />conducted. <br />8. Section (a) of the Mining Plan requires the Operator/Applicant to supply a description of the method(s) of mining <br />to be employed in each state of the operation as related to any surface disturbance on affected lands. The applicant <br />states that processing plants will be located on a portion of the amended acreage. Please describe how the facilities <br />will be managed to ensure groundwater and surface water will not be impacted. Please describe the nature and <br />storage locations for all hazardous waste that will be used on site and the measures used to contain them in the <br />event of a spill or leak. <br />9. The Mining Plan indicates that the Central Colorado Water Conservancy District (CCWCD) conveyance ditch may <br />be relocated during mining and reclamation activities. Please be aware that an agreement between the Applicant <br />and the CCWCD indicating that CCWCD approves of this adjustment must be submitted to the Division prior to <br />approval of this aspect of the amendment application. Additionally, the Applicant must specify to where the ditch <br />will be relocated and supply structural design specifications for the new ditch to the Division for review. <br />10. The Mining Plan specifies that roads, fences, and other structures located within the proposed permit boundary <br />may be removed during the mining process. Please be awaze that the Division needs to be informed as to what <br />changes will take place on the site, including what features and structures will be removed, during the amendment <br />review process. This information is necessazy for an accurate bond calculation. Please specify exactly which <br />features and structures will be removed. <br />11. The amendment application indicates that if necessary, water from trenches will be circulated through a settling <br />basin prior to it being discharged to the South Platte River. What parameters will be used to determine whether it <br />is necessary to circulate the discharge water to the settling basin? <br />12. The Mining Plan indicates that a recycling plant is present on the proposed amendment area. The plant will recycle <br />concrete and asphalt. Please specify whether any fines or residue from the recycled materials will remain on site. <br />Additionally the plan indicates that materials from the neazby Wattenberg Lakes site will be used to backfill at the <br />site. Please be awaze 3.1.5 (9) of the Constmction Materials Rules and Regulations specifies that the use of any <br />offsite material as backfill requires that a notazized letter be presented to the Division indicating that the materials <br />are inert. The letter must include approximate volumes of imported materials that will be used as backfill as well <br />as other pertinent information denoted in the rule. Please supply this letter to the Division. <br />Rule 6.4.5 Exhibit E- Reclamation Plan <br />13. The Reclamation Plan must be more specific with regard to the reclaimed acreage that will contain groundwater <br />lakes as opposed to backfilled wetlands and backfilled industrial areas. This information is necessary for <br />calculations of augmentation amounts and for calculations of bonding for backfill quantities. Please specify the <br />acreages on the reclaimed site that will consist of backfilled wetland/upland areas, backfilled areas for future <br />industrial use, and groundwater lakes. <br />14. The Amendment application specified that the post mined land use for the site will consist of a combination of <br />pastureland and light industrial use. The original permit application indicated that the post mined land use would <br />be a developed water resource. Please submit proof from the county that this area is zoned for light industrial use. <br />Additionally, please be awaze that the reclamation plan will have to included topsoil grading and revegetaion for <br />
