the proposed industrial use area until it can be established to the Division that formal arrangements have been made <br />for businesses to use this portion of the permit area for industrial use. <br />15. The amendment application indicates that some roads inside of the proposed amended area and existing permit <br />boundary will remain for access and maintaining the wetland mitigation and banking areas and the CCWCD wells. <br />It does not appear that these roads are depicted on the Reclamation Plan Map and aze not specifically identified in <br />the Reclamation Plan. Please specifically identify which roads will remain after reclamation. <br />16. The submitted Reclamation Plan indicates that topsoil will be replaced at a rate ranging from 2 to 6 inches in depth. <br />The Division typically approves a minimum of 6 inches of replaced topsoil unless extenuating circumstances <br />prevent applying this thickness. Please commit to replacing 6 inches of topsoil at the site or explain why this <br />thickness cannot be achieved. <br />Rule 6.4.7 Exhibit G -Water Infonnation <br />17. An internal review by the Division of floodplain issues for the site is being conducted by Allen Sorenson. Results <br />of this review will be sent sepazately. <br />18. The applicant should be aware that 3.1.6 (1) of the Construction Material Rules and Regulations requires that <br />disturbances to the prevailing hydrologic balance of the affected land and to the surrounding azea and to the <br />quantity and quality of water in surface and groundwater systems both during and after the mining operation and <br />during reclamation shall be minimized. In that the proposed operation includes dewatering of the pits, the potential <br />for impacts to groundwater exists. Please indicate how the hydrologic balance of groundwater in and azound the <br />permit site will be monitored. <br />19. Rule 6.4.7(1) requires the operator to directly state if surface water or groundwater will be affected by the mining <br />operation. The applicant located wells within 600 feet of the affected land. A majority of the identified alluvial <br />groundwater wells are within 300 feet of the mining limit, and will most certainly be impacted by the mining <br />operation. In accordance with Rule 6.4.7(2)(b), the Division requests that the applicant identify and chazacterize <br />the aquifer to be mined in or through. The Division also requests that the applicant define or predict the cone of <br />depression expected for any azeas to be dewatered. The cone of depression and assessment of other effects should <br />define, at a minimum, the horizontal and vertical extent of expected impacts. If during the assessment, the <br />applicant determines that a drawdown effect will occur oflsite that may impact a current groundwater user, the <br />applicant should explain any mitigation measures to be implemented and trigger points that would cause mitigation <br />measures to be put into effect. <br />Rule 6.4.8 Exhibit H -Wildlife Information <br />20. Section (1) (c) requires the ApplicanUOperator to included the presence and estimated population of threatened or <br />endangered species from either federal or state lists. In that the area and the habitat present on the proposed site <br />may likely be home to federally listed species -specifically Prebles Meadow Jumping Mouse, it is necessary for <br />the Division to receive a letter from the U.S. Fish and Wildlife Service indicating that the mining plan has <br />clearance through them prior to approval of the amendment. Please contact the U.S. Fish and Wildlife Service <br />regarding the proposed mining operation. <br />Rule 6.4.12 Exhibit L -Reclamation Costs <br />21. The Division will estimate the cost to reclaim the site once the applicant addresses the concerns noted in this letter. <br />The Division will estimate a cost to reclaim the site based on the information submitted in the application and <br />responses to this adequacy review. <br />Rule 6.4.13 Exhibi[ M -List of Other Permits and Licenses Required <br />
