Cattany <br /> Division Director <br />Re: Timely Objection, Penrose Ranch Pit, AM-02 Application, M-1992-O1fi <br />Dear Mr. Smith: <br />Enclosed is a copy of an objection that the DMG received on Mazch 31, 2003. The objector has <br />complied with Rule 1.7 so she will become a Party (as defined) to the application process and the <br />matter will be set for a heazing before the Board. In addition, pursuant to Rule 2.7, the Division <br />will hold apre-heazing conference within 30 days after the close of the public comment period <br />(by May 8, 2003), unless the objector withdraws her objection. <br />As you recall, your first public notice had a significant error with the comment period. Pursuant <br />to Rule 1.6.6, you were required to publish a new notice. You were notified on February 21, <br />2003 to re-publish notice. According to the recent proof of publication the first notice was <br />published on February 26, 2003 and the last publication was March 19, 2003. The comment <br />period will expire on April 8, 2003. Pursuant to Rule 1.6.6, in the event that the Applicant is <br />required to issue a new notice, all applicable deadlines shall begin to run anew.
