Cattany Division Director Re: Timely Objection, Penrose Ranch Pit, AM-02 Application, M-1992-O1fi Dear Mr. Smith: Enclosed is a copy of an objection that the DMG received on Mazch 31, 2003. The objector has complied with Rule 1.7 so she will become a Party (as defined) to the application process and the matter will be set for a heazing before the Board. In addition, pursuant to Rule 2.7, the Division will hold apre-heazing conference within 30 days after the close of the public comment period (by May 8, 2003), unless the objector withdraws her objection. As you recall, your first public notice had a significant error with the comment period. Pursuant to Rule 1.6.6, you were required to publish a new notice. You were notified on February 21, 2003 to re-publish notice. According to the recent proof of publication the first notice was published on February 26, 2003 and the last publication was March 19, 2003. The comment period will expire on April 8, 2003. Pursuant to Rule 1.6.6, in the event that the Applicant is required to issue a new notice, all applicable deadlines shall begin to run anew. So, since you were notified to re-publish on February 21, 2003, the 90-day review period will expire on May 22, 2003 and the item will be scheduled for the May 28-29, 2003 Board meeting (unless the objector wi tldraws her objection).
