Stevens <br />Date: July 6, 1992 <br />Re: San Luis Project (Permit M-88-112) Adequacy Review of Proposed ")rR-09 Surface <br />and Ground Water Containment Plan <br />l have reviewed Proposed TR-09, referenced above, for adequacy and have the following <br />comments. <br />1. The drilling and testing of the additional monitoring wells approved in TR-08, <br />comprising Phase 1 of this proposal, will not be completed in time for evaluation <br />of the data, development of a ground water containment plan, and Dfivision <br />review by the mandated decision date of July 15, 1992 for TR-09. <br />BMR should waive their right to a decision on TR-Q9 by July 15, 194Q to provide <br />enough time to assemble the data, evaluate, and propose a ground water contain- <br />ment plan that could be considered by the Division for approval. <br />2. There is some doubt that the Division will be provided with the results of the <br />second phase, i.e., data evaluation, of the development of the proposed ground <br />water containment plan. The cover letter indicates "if necessary," although page 2 <br />of the proposal commits to submitting this "documentation to CMLRID." <br />The Division considers it necessary to its determinations and review of BMR's <br />proposed ground water containment plan, whatever that may be, that all testing <br />data, descriptions, modeling and evaluations made in conjunction with or leading <br />to BMR's proposal be provided. If this is not entirely agreeable to BMR, i.e., if <br />there are conditions to submittal of this data on BMR's part, the proposal should ~ <br />clearly state these conditions. <br />3. There is no frequency specified for the proposed sampling of the pump discharge <br />from the ground water containment wells in conjunction with a ground water <br />remediation program. There is no indication of which forms of cyanide would be <br />determined. <br />
