File No. M-1989-120 Natural Resource Trustee <br />Platte Valley Operation 112(c) Amendement Application -Second Adequacy Review <br />Dear Mc Schenderlein, <br />Listed below are second adequacy review comments for the Platte Valley Operation 112 (c) Amendment Application <br />(AM-001), File No. M-1989-120. The Division of Minerals and Geology ("Division") is required to make an approval <br />or denial decision no later than December 12, 2003, therefore, your response to the following adequacy review <br />concerns should be submitted to the Division as soon as possible. <br />1. Rule 1.6.5 (2), requires proof of publication of the public notice circulated in the local newspaper and all owners of <br />record of surface lands, and easement holders that are on the affected land and within 200 feet of the boundary of <br />the affected land. The proofs of notice submitted with the amendment application do not indicate that the utilities <br />within 200 feet of the boundary have been notified. The map indicates that power lines and at least one gas line are <br />located within the above parameters with regard to the added acreage in the amendment, Therefore the owners of <br />these utilities must be included in the notification process. Please notify these utilities, if they have not yet been <br />notified, and supply proof of notice to these entities. <br />2. It was noted that the landowner of some of the property involved in the amendment is identified as CAMAS <br />Colorado Inc. on the submitted maps. There is not proof of notification to CAMAS Colorado Inc. in the <br />information submitted with the amendment application. A search on the Secretary of State website for the State of <br />Colorado indicates that CAMAS Colorado Inc. merged with and exists now as a part of Aggregate Industries - <br />WCR, Inc. Therefore it is not necessary for the Applicant to notify CAMAS Colorado Inc. of the amendment <br />application. <br />Rule 6.4.3 Exhibit C- Pre Mining and Mine Plan Map(s) of Affected Land <br />3. Section (a) of the Pre-Mining and Mine Plan Map(s) of Affected Land requires the Applicant to supply the name <br />and location of all creeks, roads, buildings, oil and gas wells and lines, and power and communication lines on the <br />area of affected land and within two hundred (200) feet of all boundaries of such azea. The owners of the oil and <br />gas facility and the utilities do not appeaz on the map. Please supply this information. <br />Rule 6.4.4 Exhibit D- Mining Plan <br />4. Section (a) of the Mining Plan requires the Operator/Applicant to supply a description of the method(s) of mining <br />to be employed in each state of the operation as related to any surface disturbance on affected lands. The applicant <br />has indicated that the operation will operate under Spill Prevention, Control, and Countermeasure Plan, a Colorado, <br />Dischazge Permitting System discharge permit, and that no hazardous materials will be generated by the facilities <br />at the site. Please state whether materials, such as fuels and lubricants, will be stored on the site, and describe how <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geological Survey <br />
