BANTA, Director
May 4, 1988
Climax Molybdenum Company
Henderson Mine
Charles L. Jackson
Resource manager
Box 68
Empire, CO 80438
Re: Technical Revision Partial Approval, File No. 77-342
Dear Mr. Jackson: TR ~S
This letter confirms our phone conversation of April 26, 1988 concerning your
request for technical revision (TP.).
We received the TP, application on April 8, 1988. It calls for:
(1) Submittal of a replacement financial warranty and establishment of a
reclamation trust fund:
(2) Revising topsoil replacement requirements;
(3) Revising topsoil stockpile, road and diversion canal locations.
Financial Warranty
Your request to submit a replacement warranty and establish a reclamation
trust comply with Rule 7. Therefore; it is approved in accordance with
P.u1e 1.9. I have enclosed copies of forms necessary to substitute a
letter of credit for the surety bonds and to establish a reclamation
trust. Diana Bills is responsible for all matters concerning financial
warranty in our office. Please contact her about the procedures for
implementing the changes. I don't think we've ever had a request to
establish a reclamation trust fund, so we will be breaking new ground if
you decide to qn this route.
Topsoil Replacement Requirements
We agreed to defer consideration of this point of your request until
we've had a chance to inspect the site and evaluate revegetation
monitoring data. As you know, our concern stems from the lack of
virtually any successful tailings revegetation work in Colorado. This,
combined with the large affected area of tailings will cause us to be
very cautious. In all fairness, I should mention that the only long-term
tailings revegetation in Colorado was accomplished by Amax at the Urad
site. However, all of the techniques used at Urad have not been
transferred, i. e., waste rock cover, so we need to look at the Henderson
tailings on a site specific basis. I'll be contacting you soon to set up
an inspection date.
215 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel. (303) 866-3567
