A revised_ page 2 of the application form with the company's new address accompanies this <br />letter. <br />2. A revised page 3 ofthe application with second present property owner added accompanies <br />this letter. In addition, per our discussion, I have re-notified both of the present property <br />owners by Certified Mail. A copy of the mailed Notice along a copy of the Return Receipt <br />also accompanies this letter. - <br />3. We have added the names of the four utility companies (United Power, Xcel Energy, Qwest; <br />and South Adams W&S District) to the list of utility owners with utilities above or <br />underground in 104`s Avenue to EXHIBIT C-1 SHEET 2 OF 2 MAP. However, no mining <br />is proposed within 200' of 104' Avenue. A note to this affect has been EXHIBIT C-2 SHEET <br />2 of 2 MAP, and this restriction has also been included in the text of EXHIBIT D and <br />EXHIBIT S. <br />4. We have revised the line widths of mining setback limits and the affected land boundary of <br />permit area on both of the EXIIIBIT C MINING PLAN MAPS. <br />5.' The reference to Sinclair pipeline in the exceptions to the property owner's deed is not <br />relevant to the proposed amendment area. This Sinclair pipeline is along 100'h Avenue, and <br />the property being purchased includes a 10' strip of land along the right-of--way of 100'" <br />Avenue. However, while this 10' strip will be purchased by Aggregate Industries as part of <br />the total land purchase, this 10' area and the pipeline's location is not within 200' of the <br />.proposed amendment permit area. <br />
