The Division of Mining, Reclamation and Safety <br />(Division) is required to make an approval or denial decision no later than March 19, 2007, <br />therefore, your response to the followil3g adequacy review concerns should be submitted to the <br />Division as soon as possible. <br />1. As required by Rule 1.6.2 (1)(g), pllease submit the proof of publication of the public notice <br />circulated in the local newspaper, a.ll owners of record of surface lands, mineral rights, <br />easement holders, and owners of record of surface lands that are within 200 feet of the <br />boundary of the affected land. Proof of notice maybe return receipts of a Certified Mailing <br />or by proof of personal service. <br />2. The maps submitted with the AM-(Il application are inconsistent with the area labeled as <br />"Existing Permit M-1981-079." Same of the maps depict this area, and others do not. <br />Division's records indicate that in 2001 permit M-1981-079 was incorporated into the Trout <br />Creek permit are area and it was reP.eased under the old permit number. This azea is <br />considered an active part of the permit azea and will need to be included on all maps. Please <br />revise the maps accordingly. <br />Rule 6.4.5 Exhibit E- Reclamation Plazt <br />3. The applicant states that no topsoil will be removed or stockpiled on the amended acreage. <br />The reclamation plan for the current azea requires that topsoil covered from the historic flows <br />of Trout Creek be salvaged and amended with fertilizer. The applicant should commit to the <br />same practice on the amended area and state where the material will be spread upon final <br />reclamation. <br />4. The applicant states that a lazge depression area will be created upon final reclamation. <br />Please specify the dimensions of the depression (length, width, depth) and the anticipated <br />side slopes.
