5. The applicant states that portions of the amended acreage may not be reclaimed due to <br />extensive water and drought conditions. Please further justify why these areas will not be <br />reclaimed and depict the areas on the reclamation plan map. In accordance with Rule <br />3.1.10(8), the Division will only allow azeas not to be reclaimed if a permanent pool or lake <br />will be formed. <br />6. Sediment accumulation on the floor of the pit over time would tend to reduce infiltration. <br />The Operator must commit to cleaning out the lower pit as necessary, and must describe how <br />and where the removed sediment will be disposed. Please also explain how the depression <br />will function over time to ensure that long term maintenance is not warranted. <br />7. Please provide the rate of seeding the disturbed azea in pounds of Pure Live Seed per acre <br />(PLS/Acre). The Division recommends a range of 25-40 seeds per squaze foot for drill <br />seeding (double that amount for broadcast seeding). In addition, please state if mulch and <br />fertilizer will be used and include the type, rate and application method. <br />8. Please state if the proposed seed mixture under AM-Ol will be used on other portions of the <br />site. The Division reviewed the existing permit, and alfalfa is the only specie to be planted <br />on site. Alfalfa is adequate for the low lying azeas, however, not for the quarry rock crop <br />azeas. <br />9. The applicant provided a seed mixture that contains Crested Wheatgrass and Annual Rye. <br />The Division has found Crested Wheatgrass to be an aggressive introduced specie that forms <br />a monoculture and competes with other native species. The Division recommends that you <br />remove Crested Wheatgrass from the seed mixture and instead include Sideoats Grama and <br />Indian Ricegrass which are both native and found in the region. In addition Annual Rye is <br />considered a cover crop and not a perennial grass. The Division recommends that you <br />remove this specie from the seed mixture. <br />10. Rule 3.1.10 requires that methods of weed control be employed for all prohibited noxious <br />weed species, and whenever invasion of a reclaimed azea by other weed species seriously <br />threatens the continued development of the desired vegetation. Please provide a weed <br />management plan in the event that weeds infest the mine site. <br />Rule 6.4.7 Exhibit G- Water Information <br />11. The Division received comments from the Office of the State Engineer (OSE) regazding AM- <br />Ol. The OSE states that exposure of ground water must not occur during or after mining <br />operations. If stormwater is contained on-site, it must infiltrate into the ground or be released <br />to the natural stream system within 72 hours, or all work must cease until a substitute water <br />supply plan, or augmentation plan approved by water court is obtained. Please commit to <br />releasing the water within 72 hours or obtaining a substitute water supply plan or <br />augmentation plan. <br />Attached are comments from the Bureau of Land Management, Office of the State Engineer, <br />Colorado Historical Society and the Division of Wildlife regazding the AM-Ol application. If <br />applicable, please respond to their comments and/or recommendations. <br />2 <br />
