Munger Canyon Mine <br />Dear Sv or Madame: <br />I am contacting you with regard to the above Notice of Violation, in accordance with <br />Section 5.04.3(1) of the Rules & Regulations of the Colorado Mined Land Reclamation <br />Board for Coal Mining, in order to submit information to determine the facts surrounding <br />the violation. <br />The NOV refers to failing to "complete interim reclamation at the Munger Mine bench as <br />contemporaneously as practical with mining operations." <br />There were several factors that have relevance to this. <br />First, I understood our engineer at Lodestar Energy, Inc. Mountain Operations main <br />office in iJT' was working on the pertinent paperwork on a timely basis. I subsequently <br />discovered he had missed more than one deadline he had agreed upon with Dan <br />Mathews, the Division of Minerals & Geology inspector who works with us at the mine. <br />When this became evident the General Manager of the Mountain Operations, Mark <br />Wayment, worked on the project himself. I feel it worth noting the engineer is no longer <br />with the company. <br />Second, there was a heavy storm in the area on the evening of August 21, 2001. I <br />supplied evidence from the National Weather Center of its severity. to Dan Mathews. The <br />report measured up to 4" of rainfall in this immediate area. On a short-term basis this not <br />only effected the work on the Munger site, but also involved substantial cleanup work at <br />the nearby McClave Canyon mine, where my crew and I actually produce coal. This <br />cleanup work took a great deal of effort, man hours, and other resources spent over a <br />considerable period of time, some of which could and would have been utilized at the <br />Munger location. <br />Third, at the same time we were conducting other reclamation work at our Loma loadout <br />site, per Dan Mathews. This obviously again took up man-hours, especially with regard <br />to our surface equipment operator, as well as tying up the equipment itself.
