RE: Basin Resource's Request to Vacate Notice of Violation
(NOV X-92-O1)
The Division received a written request from Basin Resources to
vacate notice of violation X-92-O1. According to staff procedures,
written recommendations regarding vacations are sent to the
Director to be reviewed. Below is a brief out line the chain of
events that resulted in the NOV.
July 7, 1992- Basin Resources filed a Notice of Intent to Explore
for Coal Application to the Division.
July 21, 1992- Division deemed the application incomplete because
of Basin Resources failure to submit a statement from the Division
of Wildlife to determine whether the exploration and reclamation
activities will jeopardize the continued existence of endangered
and threatened species (Rule 2.02.2).
August 26, 1992- DOW statement was submitted to the Division and
the NOI was deemed complete. DOW recommended that exploration
activities be scheduled to avoid the period from August 15 through
October 1st (black bear), and December 1st through March 31st
(deer, elk, and bald eagle).
September 17, 1992- NOI X-92-213-00 was approved with DOW
conditions (conduct exploration activity between October 2nd
through November 30th and/or April 1st through August 14th to
minimize the impacts on wildlife).
November 23, 1992- Basin Resources requested'an extension of the
drilling deadline to December 15, 1992 to provide adequate time to
complete the project.
November 25, 1992- DOW approves the extension of the drilling to
December 15, 1992.
November 27, 1992- DMG approves the extension of the drilling to
December 15, 1992.
