December i5, 1992- Basin Resources contacted the Division regarding
further extension of the deadline to December 23, 1992. I stated
on the telephone that the DOW must be notified and approve the
extension before the Division can grant approval. Letter was sent
out on December 17, 1992 informing Basin Resources to contact DOW
for approval.
December 17 & 18- Phone call from Krassa, Lindholm, Kumli &
Madision representing Richard Babnick stating that Basin Resources
was still drilling on hole NM-4 as of this date.
December 21, 1992- The Division received a written citizen
complaint from Richard Babnick requesting an inspection of NOI X-
92-213-00.
December 22, 1992- A citizen complaint inspection was conducted.
Drilling activity was not being conducted on the date of the
inspection. Ron Thompson of Basin Resources stated that drilling
continued on December 15, 16, 17 and 18. The Division issued NOV
X-92-O1 based on this information.
December 22, 1992- NOV X-92-O1 was terminated.
January 6, 1992- Basin Resources requested NOV X-92-O1 be vacated.
I have a few comments to add to Basin Resource's letter requesting
that NOV X-92-O1 be vacated.
Division agrees with this statement.
2. Basin Resources stated that DOW's concerns were for the area
along the South Fork of the Purgatoire River, and that DOW made a
distinction between the South Fork area and North of Highway 12.
DOW's letter to the Division dated August 26, 1992 addressed the
entire area as the South Fork of the Purgatoire. The Division made
the special condition to the NOI based on the letter submitted to
the Division. On the map it appears that the entire area is in the
South Fork of the Purgatoire river.
Division believes this statement to be true.
4. Basin Resources contacted the Division on December 15, 1992
regarding a request for extension of the deadline to December 23,
1992. I told Ron Thompson that DOW must be notified before the
Division approves the revision. I did not give Basin Resources
oral permission to continue with the drilling as stated in the
letter. Basin Resources submitted the written request to revise
the NOI as suggested by the Division.
