5. The conversation on December 15, 1992 reiterated that written <br />and oral approval of the deadline extension could not be approved <br />by the Division until the DOW approved such conditions. This was <br />followed up with a letter on December 17, 1992. I told Ron <br />Thompson that the condition was placed on the NOI as a result of <br />comments from DOW, and they must be notified by the permittee to <br />extend the deadline date. <br />6. The Division was informed that all drilling and reclamation <br />activities were completed on December 18, 1992. The letter states <br />that all activity was completed and vacated on December 22, 1992. <br />Basin Resources requests that the NOV be vacated on the fact that <br />DMG gave oral permission to allow completion of hole NM-4. The <br />Division in fact did not give Basin Resources permission to <br />complete drilling, but told them to contact DOW to obtain such <br />approval. This statement was expressed by telephone and later sent <br />by mail to Basin Resources. Based on this information, the <br />Division acted properly in issuing NOV X-92-01.
