Cattany <br />Acting Division Director <br />l/ <br />DMG has completed the preliminary adequacy review of your application for Amendment No. 1 (AM-01) <br />to Permit No. M-2000-049. The application cannot be approved until the following issues are <br />adequately addressed. Please submit a response to the following issues as soon as possible, but no <br />later than June 12, 2003 so the decision due date set for June 19, 2003 can be met. If you cannot <br />respond by June 12, 2003 please submit a written request for extension of the decision date. If your <br />response, or an extension request, are not received by June 12, 2003 this application may be denied. <br />ADEQUACY ISSUES <br />1. The application form and Exhibit G mention operation of a wash plant. This is a newly <br />proposed processing feature at this site. Please include mention of this operation in the list <br />of facilities in the Exhibit C text and give detailed specifications in Exhibit D. Include <br />construction features designed to protect groundwater resources and details for handling of <br />pond cleanings. <br />2. Please document that the right to use the waste irrigation water, specified to be used for <br />the washing operations is held by Michael DeJohn. The original permitting process notes <br />indicate that the waste irrigation water that leaves the DeJohn property and flows across <br />the old Smesrud property had been filed on by adown-gradient neighbor. <br />3. Please ensure that approval for operation of a wash plant facility is secured from Montrose <br />County (if required) and that the appropriate comment is added to Exhibit M. <br />4. Louisiana Land and Gravel, LLC has entered into an agreement with Farmer's Water <br />Development Company to install a clay liner in the section of the Gurley Ditch that runs <br />along the northeast side of Phase I prior to excavating within 200 feet of the ditch. Please <br />include engineering specifications for this liner installation and the expected performance <br />details. <br />5. Given that the area along Gurley Ditch is eagle nesting habitat, and that the permit area lies <br />within deer and elk critical winter range, the operator will need to obtain an updated <br />comment letter from the Colorado Division of Wildlife regarding this proposed amendment. <br />
