Cattany <br />Division DirecYar <br />Natural Resource Trustee <br />I have reviewed the recent submittal in response to the Division's preliminary adequacy review. It was hand- <br />delivered to the DMG Durango office on your behalf by your agent, Matt Carnahan on 1/11/06. Most all of the <br />outstanding technical concerns have been adequately addressed. There are a couple items that I will comment on <br />below, and if my statements meet with your approval no further response from you is necessary. All items that I do <br />not comment on are considered to be adequate at this time. <br />Exhibit C -Pre-minine and Minin¢ Plan Ma T~s <br />The maps are adequate overall, except for one item: there is no labeled "permit boundary line." I have discussed <br />this with Mr. Carnahan, and he stated that the heary, outermost line (identified as "limit of affected area's is <br />intended to be the permit boundary line, and should be considered such. Rather than resubmit another set of revised <br />maps, he and I agreed that I could add the label "permit boundary line" to that symbol, on both maps. <br />I have noted the slight change in the boundary line, to now include the NE corner of the original 110 permit area. <br />(This small area, as well as any other one that is not disturbed by mining and will not be during the permitted <br />operation, may someday be released from the permit. However, areas that are within the permit boundary but are <br />not planned for disturbance will not need to be bonded.) <br />Exhibit E -Reclamation Plan <br />The seed mix, as revised, is a good improvement over the original one proposed. However, though it gives the <br />relative proportions of the several species, the total application rate is given as a range of pounds per acre. <br />Normally a specific total weight per acre is given, resulting in a correct seeding rate. It also allows a specific <br />reclamation cost to be calculated. In order to obtain a specific cost, I will calculate the correct rate (presumably <br />within the 12 to 15 pounds per acre range) and use that in my bond estimate. <br />Exhibit F -Reclamation Man <br />The same comment about the lack of the labeled "permit boundary line" is true here also, as well as the agreement <br />that I add that label to the appropriate symbol on this map. <br />Exhibit L -Reclamation Costs <br />I will begin my bond estimate early next week, while awaiting any response that maybe forthcoming about these <br />issues. <br />Conl, <br />Office of Office of Colorado <br />Mined Lard Reclamation Active and Inactive Mines Geological Survev <br />
