RE: Pueblo Paving, Inc. - File Nos. 80-233 and 80-246, Notice of
Possible Violations for Failure to Maintain Financial Warranties
Dear Mr. Martino:
Pursuant to the authority granted pursuant to C.R.S. 34-32-124(1), it has
been determined that the Colorado Mined Land Reclamation Board has
reason to believe that certain provisions of permit Nos. 30-233 and
80-246, issued to your company, have been violated.
The provisions alleged to have been violated are, for permit No. 80-246:
1) Recital C, paragraph 1, beginning at the bottom of page 1 and
Recital C, paragraph 3 on page 2, of permit No. 80-246 issued to
your company on February 28, 1981;
2) Under the section labelled "GRANT, CONDITIONS AND AGREEMENTS,"
condition and agreement number 1 on page 3 of permit No. 80-246
issued to your company on February 28, 1QR1.
The provisions alleged to have been violated are, for permit No. 80-233:
1) Those conditions, recitals and agreements which state that the
proposed mining and reclamation operations can be carried out in
conformance with the requirements of the Act (the Mined Land Reclamation
Act, C.R.S. 34-32-101 et se .) and that the operator agrees to be
bound by all applicable requirements of the Act and all applicable
rules and regulations of the Board, as amended from time to time.
