'~~ <br />Mr. Al Martino • -2- <br />.February 14, 1984 <br />The fact(s) constituting the alleged violation(s), for both permits, are: <br />The failure to maintain adequate financial warranty. Financial <br />warranties for both permits have been cancelled by the surety, a <br />fact of which you were notified in correspondence from Michael Stanton <br />to yourself, dated October 13, 1983. <br />Therefore, pursuant to C.R.S. 34-32-124 you are hereby notified that the <br />matter has been scheduled for a meeting of the Colorado Mined Land <br />Reclamation Board to be held in Room 110 of 1313 Sherman St., Denver, <br />Colorado, on February 22-23, 1984, commencing at 9:00 a.m. each day. <br />Your matter will be heard as soon after commencement as possible. Please <br />call this office on February 20-21 for a more specific day and time. <br />At the meeting, the Board will consider the alleged violations and corrective <br />actions and may also consider levying a civil penalty, pursuant to the <br />authority granted pursuant to C.R.S. 1973, 34-32-124(7), which states: <br />"Any person who violates any provision of any permit issued under <br />this article shall be subject to a civil penalty of not less than <br />one hundred dollars per day nor more than one thousand dollars <br />per day for each day during which such violation occurs: except that <br />any operator who operates under a permit issued under Section 34-32-110 <br />shall be subject to a civil penalty of not less than fifty dollars <br />nor more than two hundred dollars per day for each day during which <br />such violation occurs." <br />The Board may also consider initiating proceedings to revoke your permits <br />and forfeit the financial warranties. <br />Please call, if you have any questions. <br />Sincerely, <br />~oseph G. ~`Z~1-kind <br />Minerals Supervisor <br />JGZ/eap <br />CERTIFIED MAIL NUMBER P 397 149 285 <br />Return Receipt Requested <br />
