Berry Division of nninerais & Geology <br />Senior Environmental Protection Specialist <br />Division of Minerals and Geology <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Re: Ten-Day Notice (TDN) X94-020-370-002, Somerset Mining Company, <br />C-81-022 <br />Dear Mr. Berry: <br />The Albuquerque Field Office (AFO) issued TDN X94-020-370-002 on <br />September 29, 1994, to the Division of Minerals and Geology (DMG) for problems <br />associated with approximate original contour (AOC) at the Somerset Mine. DMG <br />received the TDN on October 3, 1994. AFO received DMG's response concerning <br />TDN X94-020-370-002 on October 13, 1994. <br />The DMG response addresses three related issues: a demonstration that all <br />reasonably available spoil will be utilized in reclamation of the Bear Creek portal <br />area, proper end land use designation, and proper land owner concurrence <br />documentation. <br />AFO understands the DMG response to state that DMG views the AOC variance in <br />the approved permit as a permit defect because a demonstration by the operator <br />that all available spoil will be used is lacking. Since backfilling and grading has not <br />started on the Bear Creek site, DMG has elected to notify the company by letter <br />that a revision is required, rather than issue an enforcement action. <br />AFO further understands DMG to state that the Somerset Mine has been notified <br />via letter dated October 13, 1994, of a deficiency in the approved permit with <br />regard to the AOC variance and has been required to submit a revision no later <br />than 30 days from the date of the letter addressing all aspects of the AOC <br />provisions. In addition, DMG commits to approve or deny this revision no later <br />than January 31, 1995; the full period allowed by regulation. <br />
