(SEI and OSM) <br />Dear Mr. Ehmett: <br />This is to confirm our discussions of June 4, 1979 relative <br />to the referenced Notice of Violation (NOV). You should be <br />aware that Sheridan Enterprises, Inc., (SEI) will be filing <br />on Friday, June 8, 1979, an Application for Review of NOV <br />79-V-1-12. As addressed in the last paragraph of the Applica- <br />tion for Review, SEI is currently attempting to abate all of <br />the alleged violations contained in Notice of Violation No. <br />79-V-1-12. However, SEI does not waive the issue of validity <br />of Notice of Violation No. 79-V-1-12 as a result of abatement. <br />SEI is attempting to abate to avoid being served with an in- <br />valid Cessation Order and to remain consistent with its long- <br />standing policy of cooperation with federal and state regula- <br />tory agencies. <br />NO. 1 - Opening or developing a site for surface coal <br />mining operations (which includes underground <br />coal mines) without a state permit, in viola- <br />tion of 30 USC 502(a). <br />SEI submitted an application to the State of <br />Colorado for a Standard 112 Mining Permit on <br />December 27, 1978 and received a letter of <br />completeness dated January 12, 1979. The <br />technical review process was delayed however, <br />due to SEI's request for continuance to allow <br />for time to provide additional information. <br />
