<br />Mr. Thomas Ehmet~ • <br />Page 2 <br />June 7, 1979 <br />As we discussed in our June 4, 1979 meeting, this <br />particular NOV is abatable in that the State can <br />issue a permit subject to all necessary Federal <br />Approvals. In this light, I have notified the <br />Mined Land Reclamation staff that SEI will be pro- <br />viding the previously agreed upon supplemental <br />information in the very near future. <br />i believe that our meeting cleared up, somewhat, <br />the fact that OSM believes that abatement of this <br />NOV is possible on the above basis. <br />NO. 2 - Failure to pass all surface drainage from disturbed <br />area through a sediment pond. <br />The sedimentation basin has been reincorporated <br />into the sediment control network related to the <br />disturbed area. Sediment traps (straw-bales) <br />have been replaced and additional traps placed <br />so as to insure adequate runoff control. <br />This work was completed May 31, 1979. <br />As discussed in our meeting, the basin was only <br />temporarily removed and a check dam and straw- <br />bales were used in the interim to control runoff. <br />It is my understanding that our action should be <br />sufficient for abatement, and that no additional <br />paperwork or calculations will be necessary. <br />NO. 3 - Failure to maintain access roads so as to prevent <br />the additional contribution of suspended solids <br />to stream flow. The main access road has not been <br />scraped and has mud in excess of 4" deep and runoff <br />water leaving road has entered into the natural <br />drainage. <br />The access road is under construction and should <br />not be scraped at this point. You have seen photo- <br />graphs of the road shortly after your inspection <br />with no scraping having been done. The work complet- <br />ed, which you indicate is sufficient to abate this <br />notice, is the redefining of ditches and construction <br />of an additional sedimentation basis, which, along <br />
