. .c <br />,Mr. Thomas Ehmet~ • <br />Page 3 <br />June 7, 1979 <br />with replacement and positioning of additional <br />straw-bales will contain the runoff during forth- <br />coming construction phases associated with this <br />road. <br />This brings the total number of sedimentation basins <br />controlling runoff from the road to five (5). <br />It is my understanding that it is the control of <br />runoff that is critical here and that the above pre- <br />cautions should serve to satisfy your requirements. <br />NO. 4 - Failure to Post a Mine Permit and Identification Sign. <br />A sign has been posted at the site - June 4, 1979. <br />NO. 5 - Failure to maintain diversion ditch so as to pre- <br />vent additional contributions of suspended solids. <br />The sides of the diversion have slumped into stream <br />flow and small pieces of coal have been deposited in <br />the channel of diversion. <br />The ditch maintenance, in progress at the time of <br />inspection, was completed on May 31, 1979 which <br />included cleaning of the south ditch channel and <br />removal of slumpage within that channel. It should <br />be noted that coal naturally outcrops in this channel, <br />however, coaly material has been hand-picked from the <br />berm above the diversion channel and was considered <br />complete on June 4, 1979. <br />It is my understanding that you believe you will not <br />be able to abate this notice until such time that a <br />culvert is installed within the channel. This, of <br />course, has to be approved by the BLM and USGS and <br />may be delayed without expedtiuous approval from these <br />agencies. I was further led to believe that there is <br />no need for any additional approvals from the OSM to <br />abate the notices, and that I should involve only the <br />USGS and BLM at this point. <br />It is estimated that the culvert work will be completed <br />within 1-1/2 weeks of USGS and BLM approval. This <br />should still allow for time to abate. <br />
