Allen who was a Master Sergeant in the A;r Force stationed in Germany owned the
property. I was acting as his agem to care for his property and rent it far him. He contacted me by letter
asking me to seek someone who would like to have fill dirt and remove a portion of an old dump to make
room for a new house which he intended to build in Sunshine upon his retirement from the AQ Fora. At
that time, the county of Boulder was widening the county roads in the area from Boulder to Gold Hill. I
approached the county wmmissioner and the road crew with the offer of free dirt for fire road work. They
were more than willing to take the dirt and I was happy to give it to them. They removed about 500 yards,
which was not enough to afford a space big enough for a house. In subsequent years, Allen changod his
mind and decided to retire in Texas, which he did. I bought the property on 1972.
In the late 1970's, after I had purchased the property, a contractor who was putting in a leach field for
a new house in the area approached me and offered me S I.00 a yard for the remainder ofthe old mine
dump. We agreed and he removed the dump to the approximate extent that is evidem today. In doing so,
he enwuntered ao old shaft that was full of old bottles, tin cans and other trash from by gone years. The
shaft was on the intersection of the Washburn vein and the Phil Sheridan vein. Tn removing the trash and
cleaning up the area, I noticed the vein which was delineated by secondary mineralization in the supergeae
upper part of the vein. On close inspection, there was vein about l 1/2 "- 2" wide that I recognized as
being quite rich in psuedomorphs of gold after Sylvanite or rusty gold (see attached paper). Thus began the
pemtit M-1988-081.
'fire point here is that the disturbed area was not from mining but from the desire to create a flat spot
to build a workshop and garage for the house on the property and for beneficial use by the county. The site
in question is private property and in asemi-residential suburban area that will never be restored to its
pristine status and to re-seed it for that purpose is a waste of time and money. It will be used by the
residents of the property, for some use, to eternity. It is my back yard.
Some time ago 1 hired a Local man with afront-loader to remove the waste rock That East West
Mining had piled outside the permitted area (picture #1). This was at a wst to me of $1,100.00. I also re-
seededthe area at an additional cost of around $60.00. There is always a demand for fill dirt in a mountain
community that has a shortage of level gromd. Later, after talking to Carl Mount, I did additional
reclamation work with a rented Bobcat loader (Bobcat of the Rockies at I-70 and 6'" Ave.) and restored the
upper part of the site to a gradual slope. This plus re-seeding was at a personal expense of over $2,000.00.
There is no dump left on the property that resulted from modern day mining.
My point is that since Rocky Connor abandoned the site and left me the expense of all the reclamation
work, Mined Land Reclamation should credit my bond with the $1,718.41 of his bond. He certainly does
not deserve to get it back It wasn't his money in the fast place. EasNtVest Mining (a Korean investment
