Long <br />Hayden, CO 81639 Division Director <br />RE: Yoast Mine (C-94-082) <br />NOV C-96-0`8 <br />Dear Mr. Altavilla: <br />I am writing to reiterate our phone conversation earlier today, <br />regarding the abatement and termination of NOV C-96-018. we had <br />discussed two Questions. which were: <br />What type of stability demonstration does Seneca Coal <br />Company (SCC) need to conduct in order to fulfill step <br />one of the NOV abatement? <br />What is SCC's long term liability with regard to the <br />disturbance along Routt County Road 27a, in terms of its <br />permits with the Division. <br />In regard to the first question, the NOV abatement written by the <br />Division requires that SCC provide a reclamation plan for the area <br />disturbed to facilitate the dragline move which meets the <br />performance standards of Rule 4.14. In essence, this would require <br />a demonstration that the cut slope created by SCC has a minimum <br />static safety factor of 1.3. In order to complete this step of the <br />abatement, a suitable demonstration prepared by a qualified <br />registered professional engineer will need to be submitted. The <br />demonstration should be based on rock properties obtained from the <br />cut slope, or from a previous drill hole in the same stratigraphy <br />elsewhere on one of the Seneca mines. <br />
