i i <br />Depending on the results of the analysis, we foresee one of two <br />scenarios occurring. If the analysis indicates the existing cut <br />slope meets the performance standards, the analysis will suffice as <br />the reclamation plan and no additional work will be required. If <br />the analysis indicates the cut slope fails to meet the performance <br />standards, SCC would need to submit plans for increasing the <br />stability of the slope such that it has a minimum static safety <br />factor of 1.3. Those plans would need to be implemented to satisfy <br />step 2 of the NOV abatement. <br />In regard to the second question, after a suitable demonstration <br />has been made that the cut slope meets the regulatory performance <br />standards, whether in its current configuration or following any <br />necessary modifications, the Division believes that SCC will have <br />completed mitigation of the off-site disturbance cited in the NOV. <br />Because the area in question is not within the Yoast permit area, <br />and because it is within the right-of-way of the county road, any <br />future maintenance of the slope which might be required would be a <br />matter to be handled between SCC and Routt County. <br />Abatement of the NOV is required to be completed by May 23, 1997. <br />I would encourage SCC to complete the stability analysis of the cut <br />slope as soon as possible so any remedial work which might be <br />required can be completed by that date.
