In response to the NOV, received on October 23, 1995, Seneca Coal Company submitted letters to Ms. Susan Burgmaier (11-1-95) and Ms. Erica Crosby (1-11-96), containing information addressing this violation. Today, we are submitting to you condensed versions of those letters and an explanation of why we need your help. This letter contains: • A brief history of the azea in question • Quotes from DMG inspection reports • Preliminary abatement options • Redesigned channel specifics • Current abatement options • Summary and extenuating circumstances A brief history The grading in the B pit highwall area and associated drainage channel reconstruction began in September, 1994. The final pit highwall was blasted to help in highwall reduction. Dozers graded the area in late September, 1994. The topsoil was re-spread from stockpile N and reseeded during October 1994. After the snowmelt and heavy rains during the spring of 1995, a lazge gully formed in the extended portio^ of 006-NE-1 drainage channel. Seneca personnel conducted the 1995 Rill & Gully monitoring, in May, as required and submitted the maintenance plan to the DMG. During the summer of 1995, riprap was placed in the eroded sections of the channel, approximately 300 ft x 30 ft and 150 ft x 30 ft.
