Cottony <br />Division Director <br />Natural Resource Trustee <br />The Colorado Division of Minerals and Geology (Division) has finished its review of Bowie Resources <br />LLC's (BRL) adequacy response submittal, dated March 13, 2006, for Technical Revision No. 47 (TR-47) <br />for the Bowie No. I Mine. The following is the status of the adequacy review issues: <br />Since Sentient Resources USA, Inc. is no longer a company, please explain why it is still listed as <br />a 100% owner of Sentient Coal Resources, LLC? Ifnot please update page 37 of the Permit <br />Page to show Sentient Resources USA, Inc. with an end date. Also is there a new owner (owning <br />10% or greater) for Sentient Coal Resources, LLC? If in fact Sentient Resources USA, Inc. is still <br />a 100% owner of Sentient Coctl Resources, LLC please submit a permit page sholving'the owners <br />and controllers for this entity. <br />The Division has no further concerns. In the adequacy response dated March 13, 2006, BRL <br />submitted a revised page 37 of Section 2.03. <br />The revised reclamation schedule, shown in Figure 2.05-5 of the TR-47 submitta{, shows that the <br />remaining reclamation activities at the Bowie No. 1 Mine will not begin until the year 2008. The <br />Division requests that the reclamation timetable listed in Figure 2.O.i-.i be moved ahead <br />accordingly or provide an explanation as to why BRL wants to wait two years before resuming <br />reclamation operations. <br />In response to the Division's concerns, BRL had submitted a revised Figure 2.05-5 reclamation <br />schedule in the submittal dated March 13, 2006, advancing the reclamation plan by one year to <br />2007. The Division still had concerns, however, and requested that BRL begin substantive <br />reclamation operations in the spring or early summer of2006 and complete these operations within <br />one year. So, in the submittal dated July 26, 2006, BRL provided a newly revised Figure 2.05-5 <br />reclamation schedule in which a portion of the reclamation plan was advanced further in time.
