However, backfilling and grading operations at the East Mine still would not begin until 2008 <br />according to this revised reclamation schedule. Also, for the unit train loadout, there is no year <br />associated with several of the reclamation operations, only reference to note 1. This note basically <br />states that reclamation is open-ended while the Union Pacific uses the tracks. In this senario, <br />however, BRL would be delaying reclamation of the unit train loadout for a use that does not <br />apply directly to the Bowie No. I Mine. <br />The Division appreciates BRL's efforts at reclaiming the structures at the unit train loadout this <br />year. However, the Division requests that BRL revise Figure 2.05.5 to reflect that backfilling and <br />grading operations at the East Mine and the unit train loadout will begin in 2007 and will be <br />finished within one year. Concerning the unit train loadout, BRL does have the option of <br />requesting a postmining land use change with the appropriate demonstrations required in Rule <br />4.16.3. <br />The Division also requests that Figure 2.05-5 be updated to include the current reclamation work <br />at the East and West Mines. As documented in the Division's field inspection report of July 26, <br />2006, this work includes water tank removal at the East and West Mines as well as power line and <br />power pole removal and concrete demolition at the East Mine. <br />3. The Division requests that the scheduled time allocated for the remaining reclamation activities <br />shown in Figure 2.05-5 be shortened where feasible or provide an explanation as to why the <br />stated length of time allocated for these reclamation tasks is necessary. <br />[n the submittal dated July 26, 2006, BRL did not shorten the length of time allocated for any of <br />the remaining reclamation tasks, nor did BRL explain why no such adjustments were made. As <br />also requested in item number 2 above, please condense the time frames for the various <br />reclamation tasks listed in Figure 2.05-5 so that reclamation can be completed within one year. <br />4. The recommendation of the Applicant violator System (AVS) is to "issue ". <br />5.
