During that conversation, you <br />advised me that there is no Exhibit H Wildlife Information submission with the current <br />application; nor was such an Exhibit provided with the 1997 Red Canyon permit <br />amendment application. This is because the Colorado Division of Wildlife was consulted <br />and commented on the application, and thereby made recommendations which serve in <br />lieu of a Wildlife Information submission. <br />Frankly, I was unaware of this aspect of Minerals and Geology procedure when I <br />submitted the Sierra Club's objection comments, and wonder whether the governmental <br />agencies which commented on the application, the U.S. Fish and Wildlife Service and the <br />Colorado Division of Wildlife, were aware of it. It seems from what you tell me that the <br />responsibility has somehow shifted from the applicant to Division of Wildlife to provide <br />what will become the Exhibit H materials considered with respect to this permit <br />application. I have therefore written the enclosed letters to the two agencies to inquire <br />whether they were award of this situation and the weight which it appears to me their <br />comments will be accorded in the upcoming permit hearing.
