B4 <br />Colorado Springs, CO 80906 <br />(7]9)385-0045 <br />I am writing with regard to my telephone message of last week concerning the <br />Red Canyon quarry permit application, M-1985-043. I have received a mailed copy of <br />your comments to the Division of Minerals and Geology regarding the amendment <br />application. However, another matter of concern has arisen regarding the effect of your <br />comments. <br />I have spoken with James Dillie at the Division of Minerals and Geology, and he <br />informs me that there is no Exhibit H Wildlife Information submission with the current <br />application; nor was such an Exhibit provided ~.vith the 1997 Red Canyon permit <br />amendment application. This is because the Colorado Division of Wildlife was <br />consulted, commented on the application, and thereby made recommendations which <br />serve in lieu of a Wildlife Information submission. <br />I am advising you of this because, frankly, I was unaware of this aspect of <br />Minerals and Geology procedure when I submitted the Sierra Club's objection comments, <br />and wonder whether you were aware of it; and, if not, whether it would have affected the <br />nature and scope of your comments. It seems from what Mr. Dillie tells me that the <br />materials which the Colorado Division of Wildlife actually submits with respect to the <br />permit amendment application may come to constitute the whole of the quarry's "plan" <br />regarding both the Mexican spotted owl and other wildlife impacted by the quarry <br />expansion. <br />Sincerely, <br />~' _ ~'`~- <br />James E.
